On October, 15, 2018 the District Court in Legnica rejected in its entirety the action of a public entity which brought it against our Client on the basis of a construction contract from 2011, alleging the failure to address defects within warranty period. It is worth underlining that, indeed, our Client did not have arguments justifying the delay in removing the defects, which in itself was between the parties uncontested. The court in its entirety shared our firm’s legal arguments concerning the defectiveness of the construction design, the specific mechanism for payment of contractual penalties provided for in the agreement and the exclusion of the contractor’s liability in those circumstances. The judgment is now final.
